Identifying BMPs and NPDES Violations

Your agency must respond to potential NPDES violations from construction sites within its jurisdiction. Staff may be notified of NPDES violations by field observations, public complaints, or referrals from other agencies. To respond to an NPDES violation, you must be able to identify proper BMP implementation, as well as BMP deficiencies.

Requirements Specific to Orange County (skip if in LA County)

All land disturbance projects--private and public--must:

  1. Meet the minimum BMPs listed in the County's Construction Runoff Guidance Manual.

  2. Be inspected for these minimum BMPs by City staff. Most projects only require one inspection a year. Sites that disturb one acre of land or more should be inspected at least twice in the rainy season.

  3. An NPDES inspection report must be completed for each inspection. These reports are included as an attachment to the Annual Report.
